OFFICIAL SWEEPSTAKES RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1.     Sponsor: The Signed Jersey Sweepstakes (the “Promotion”) is sponsored SC30, Inc. (DBA Thirty Ink) (the “Sponsor”).

2.    Official Rules: These are the official rules (the “Official Rules”) for the Promotion. Participation in this Promotion is expressly subject to and governed by these Official Rules.  By entering the Promotion, each participant (“entrant(s),” “participant(s),” or “you”) agrees to be bound by these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to this Promotion, and to comply with all applicable rules and regulations.  Sponsor has the right to reject and disqualify you for any reason, in its sole and absolute discretion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3.    Promotion Period:  The Promotion will commence on February 14, 2025, at 12:01 a.m. Pacific Time (“PT”) and end on February 16, 2025, at 8 p.m. PT (the “Promotion Period”).  The Promotion contains a game of chance, and the computer clock of the Sponsor will be the official time-keeping device in the Promotion.

4.    Eligibility: The Promotion is open only to legal residents of the 50 United States and the District of Columbia (excluding Florida, New York, Rhode Island, and Puerto Rico), who are 18 years of age or older as of date of entry. Employees, officers and directors of the Sponsor, the National Basketball Association (“NBA”), its member teams (including the Golden State Warriors), and Thirty Ink, as well as their affiliates, subsidiaries, and their advertising, contest, fulfillment and marketing agencies (collectively, the “Promotion Parties”), as well as their immediate families (parent, child, sibling & spouse and their respective spouses, regardless of where they reside) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Promotion. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.

5.    How to enter:  To enter, during the Promotion Period, scan the QR code featured on signage outside and throughout Club Thirty / Splash at Thrive City and click the link that appears to access the entry form. Entrants will be required to provide their name and their valid e-mail address on the entry form. After submitting the entry form, entrants will receive an e-mail notification advising that they have successfully entered the Promotion and requesting confirmation that they would like to receive the Thirty Ink e-newsletter. If you would like to receive the newsletter, please respond as instructed in that email. Newsletter sign-up is not required for Entry to the Promotion.

Limit of up to one (1) Entry per person throughout the Promotion Period, regardless of the method of entry.  Each valid entry will result in one (1) Entry.  Entries that do not include all required information and adhere to these Official Rules as determined by Sponsor, in its sole discretion, will be considered void. Sponsors may, in their sole discretion, remove, delete and/or disqualify any Entry and/or Entrant it deems inappropriate or otherwise non-compliant. Sponsor is not liable for entries that are lost, late, misdirected, incomplete, garbled, incompletely received, mutilated, or illegible, for any reason. 

6.     Sweepstakes Drawing / Odds: Each day during the Promotion Period, there will be one (1) drawing with one (1) Winner (i.e., a total of three (3) drawings throughout the Promotion Period with one (1) Winner per drawing) . The drawing will approximately take place between 6:30pm and 8pm PT each day. The Winners will be selected in a random drawing by a representative of Sponsor, whose decision will be final and binding in all respects. The odds of winning a Prize depend on the number of Entries received.

7.    Winner Notification: The potential winners will be notified in person or via email (as applicable) within three (3) business days of winner selection or as soon as reasonably practicable. Potential winners will have three (3) days to respond to the notification that they have won before forfeiting their prize. Potential winners become a “Winner” only after verification of eligibility by a Sponsor. If such potential winner cannot be contacted within a reasonable time period (i.e., three (3) days), if the potential winner is ineligible, if any notification is returned undeliverable, or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and an alternate potential winner will be selected from among all remaining entries for that drawing. 

8.    Prize: Each Winner will receive a Golden State Warriors jersey signed by Stephen Curry (the “Prize”). The approximate retail value of each Prize is $5,500 (i.e., $15,000 cumulative value for all three Prizes). The odds of winning a Prize depend on the number of Entrants.

This Promotion is not sponsored, endorsed, administered, associated with, or certified by the National Basketball Association, the Golden State Warriors, Nike or Thirty Ink.  No substitution of a Prize, including cash substitutions, will be permitted, except that Sponsors have the right in their sole discretion to substitute a prize of greater or equal value if the stated Prize is not available. Prizes are not transferable or assignable. Limit of one (1) Prize per person/per household.Within at least ten (10) days of Winner verification, Sponsor will ship or otherwise deliver the Prize to the Winner using the address provided by each Winner during the Winner verification process, using such delivery method and carrier as selected by the Sponsor. 

9.    Taxes: Income and other taxes, if applicable in your jurisdiction, on the value of the prize are the sole responsibility of the Winners.

10.  Representations and Warranties:  By participating in the Promotion, you represent and warrant as follows:
(i)    All information provided by you in connection with this Promotion is truthful, current and accurate; and
(ii)   You meet the eligibility requirements set forth in these Official Rules.

11.  Additional Conditions of Participation:  By entering this Promotion, you agree to forever release the Promotion Parties from any and all actual and potential, known and unknown, suspected and unsuspected claims, demands, causes of action, liabilities, losses and damages (collectively “Claims”) arising out of or relating to this Promotion or any Prize, including, without limitation, Claims for personal injury or death, damage to or loss of property, violation of right of publicity or privacy, defamation, libel, and false light, whether intentional or unintentional, and whether under a theory of contract, tort (including negligence), warranty or otherwise.

12.  Limitation of Liability:  THE PROMOTION PARTIES SHALL NOT BE LIABLE FOR DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE PROMOTION, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR OTHERWISE, AND IRRESPECTIVE OF WHETHER EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. Some jurisdictions do not allow limitations or exclusion of liability for incidental or consequential damages, and therefore this limitation of liability may not apply to you.

 13.  Winner’s List: The names of the Winners will be available for a period of sixty (60) days beginning thirty (30) days after the Promotion Period has ended. To obtain the Winners’ names, please send a self-addressed stamped envelope to 1159 Howard Street, San Francisco, CA 94103.

 14.  Applicable law: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrants, Winners, or the Promotion Parties in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions, which might otherwise cause the application of the laws of any jurisdiction other than the State of California. Any action seeking legal or equitable relief arising out of or relating to the Promotion or these Official Rules shall be brought only in the courts of the State of California. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction they may have.

15.  Privacy: Except as noted in these Official Rules, personal information collected solely for entry in this Promotion is used only for the purpose of Promotion administration and winner notification and will not be re-used, sold, disclosed, or shared in any manner by the Promotion Parties or any third parties (except service providers who help us operate this Promotion) unless you have elected to receive additional information or promotional material from the Sponsor or a third party. Depending on where you live, you may have rights with respect to the personal information we collect about you in the context of this Promotion. For more information about these rights and our privacy practices, please contact us at info@thirtyink.com. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.

16.  Notice of Financial Incentive for California Residents: The Sponsor will collect your name and email address for entry in this Promotion. Instructions for opting into the Promotion are detailed in these Official Rules. You can terminate participation in the Promotion at any time by contacting info@thirtyink.com. The value of your personal information collected as part of this Promotion is related to the costs and expenses associated with making the Promotion available to participants.
